@tnx2014 如果是民事还好说，刑事应该由控方证明"他什么都知道"，再说这个 APP 的漏洞，明显是平安付一方的责任，使用者不应承担任何责任

自己犯错却不承担责任，反而让使用方承担责任，已经不能用店大欺客来形容了

首先，这个案件有三部分，动机，过程，结果；
其次，我认为根据已知事实，过程中的转帐行为没有非法之处；
三，结果是平安付方损失了过千万元，我认为主要责任应由平安保险承担，当事人从中获得的利益我认为是不当得利，应归还平安付，属于民事案件
四，该案刑事判刑的依据是通过当事人的动机和后果及以此认定的转帐不合法，我认为不妥当
最后，我认为通过动机来判定转帐的合法性是非常危险和错误的

@tnx2014 首先，#明知# #非法占有为目的# ＃不是正常人＃ #狡辩#，这些都是明显的情感指控，连主观陈述都算不上

其次，你说的这些，与当事人的转帐行为的合法与否没有相关性

@tnx2014 这个案件的关键就是当事人的转帐是否合法，如果转帐是合法的，我看不到给当事人刑事定罪的理由
